Judgment Enforcement

Believe it or not, simply winning your civil court case does not guarantee you payment. Instead, you are awarded a final judgment - a document signed by a Judge that declares the debtor is liable to you for a certain sum of money. Does this mean the debtor must pay? You would think so, but the answer is no. The debtor can still refuse to pay you. Understandably, you may be thinking, “What good is the judgment then?” While it does not guarantee payment, the judgment does afford the judgment creditor a number of legal enforcement remedies to use the debtor’s assets to satisfy the judgment. This is what separates us from other litigation attorneys. We specialize in using these remedies to enforce the judgments and recover what is owed to our clients.

 

Loans & Promissory Notes

Whether money was lent and thoroughly documented or simply memorialized with a handshake, we routinely help our clients secure repayment of defaulted loans. While written documentation is quite helpful, the fact that the loan was not reduced to writing does not preclude you from bringing a claim and successfully recovering what you are owed.

Foreign Judgment Domestication

If you have obtained a money judgment in another state or country and have reason to believe the judgment debtor has assets in Florida, you will likely have to domesticate the judgment in Florida to reach those assets. Domestication is a legal process through which the foreign judgment gets formal recognition by a Florida Court. Once completed, the judgment is fully enforceable in Florida, just as it would be had it been obtained here.
